GETCODE TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of getcodeapp.com, dash.getcodeapp.com, the GetCode mobile applications, and any other digital products and services owned or operated by GetCode (collectively, the "Service"). By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.


1. Parties and Contact

Note: GetCode is not a telecommunications operator. Virtual numbers and SMS reception services are provided via third‑party suppliers and carriers.


2. Definitions

Account: Your user profile on GetCode.

Credits/Coins: Prepaid digital credits used for paid transactions within the Service.

Number: A virtual phone number allocated for a limited time solely to receive verification SMS codes.

Content: All data, messages, and information sent or received via the Service by the user.


3. Eligibility and Account

3.1. You must be at least 18 years old and have full legal capacity to use the Service.
3.2. You are responsible for providing accurate, current, and complete information during registration and for keeping it updated.
3.3. You are responsible for maintaining the security of your account and password. All activities occurring under your account are your responsibility.


4. Scope and Limitations of the Service

4.1. GetCode provides a utility to receive one‑time verification SMS codes for account creation/sign‑in to online services.
4.2. The Service may not be used for emergency communications, disaster alerts, person‑to‑person messaging, bulk SMS sending, or continuous communication.
4.3. Numbers are temporary; after the allotted time, the number is reclaimed and may be re‑assigned. GetCode is not responsible for messages not received before expiry or any consequences of re‑use thereafter.
4.4. Carriers, target platforms, or third parties may change technical rules or policies; delivery success rates are not guaranteed.


5. Acceptable Use Policy (AUP)

The following activities are strictly prohibited. The list is illustrative and not exhaustive; comparable abuses are deemed covered.

5.1 Unlawful or High‑Risk Uses

Any unlawful activity or conduct contrary to public order or morality.

Financial fraud, identity theft, account take‑over (ATO), phishing, social engineering.

Anti‑money‑laundering (AML) violations, terrorism financing, dealings with sanctioned countries/persons.

Illegal gambling, narcotics, weapons, forged documents, or other criminal activities.

Child sexual abuse material, sexually exploitative content, hate speech, or incitement to violence.

5.2 Uses Conflicting with Platform/Provider Rules

Registration/sign‑in in a manner that violates target services’ terms (social networks, messengers, financial institutions, etc.).

Multi‑accounting/ban evasion, bypassing age or geo restrictions, impersonation of persons or entities.

Bots, automation, device farms, emulators generating fake traffic or interactions.

Manipulation of referral/bonus/coupon systems, self‑referral abuse.

5.3 Communications, Spam, and Abuse

Bulk/automated SMS sending or using the Service as an SMS gateway.

Unsolicited communications, spam, deceptive redirects, abuse of link shorteners.

Use as a substitute for emergency/critical communications.

5.4 Privacy and Personal Data Violations

Unlawful processing, sharing, or sale of third‑party personal data.

Unauthorized profiling or tracking via device fingerprinting, location, IP, cookies, or similar.

Mass data scraping from target services; CAPTCHA‑solver or similar bypass tools.

5.5 Technical Abuse and Security Violations

Unauthorized access, credential/session sharing, vulnerability scanning or penetration attempts.

Reverse engineering, code extraction, cryptography/DRM circumvention, API traffic manipulation.

Attacks disrupting the Service, carriers, or target services (DoS/DDoS, etc.).

Sale/resale/rental/transfer of numbers or messages; brokering activities.

Generating traffic intended to evade security and risk controls via VPN/proxy/rotating or residential IPs.

5.6 Fair Use and Operational Limits

Excessive attempts within a session or successive failed attempts beyond reasonable thresholds.

Concurrent use of the same number across different platforms or sharing across multiple sessions.

Disproportionate API/request volumes or automated queries that impair service quality.

Current thresholds may be announced in the Service and updated from time to time.

5.7 Enforcement

Upon detecting violations, accounts may be suspended or terminated; related credits/balances may be partially or fully frozen.

Depending on severity, device, IP, or payment method bans may be applied.

Additional verification (KYC), documentation, or investigative review may be required.

Where criminal conduct is suspected, reports may be filed with competent authorities and logs may be disclosed in accordance with law.

GetCode may seek indemnification for all losses and damages arising from violations.

5.8 Notice and Cooperation

You must promptly report suspicious activities on your account to [email protected].

GetCode may cooperate with suppliers, carriers, and target services in abuse prevention.


6. Pricing, Payments, and Subscriptions

6.1. Paid transactions are conducted with credits/coins. Purchases are prepaid and invoiced as required by applicable law.
6.2. If you enable subscription/auto‑renewal, charges will be made to your payment method at the stated intervals. You may disable auto‑renewal at any time in your Account settings.
6.3. Refund Policy: Credit/coin purchases are non‑refundable. For undelivered single transactions, GetCode may issue a credit/coin adjustment instead of a cash refund. Mandatory consumer rights (e.g., statutory withdrawal where applicable) remain unaffected.
6.4. Price changes will be communicated in advance and will apply prospectively; existing subscriptions are updated after the effective date.
6.5. Taxes (e.g., VAT) and fees may be charged in addition, pursuant to applicable law.


7. Number Allocation, Message Delivery, and Fair Use

7.1. Each number is allocated only for the specified platform/service and time/session.
7.2. Where fair‑use thresholds are exceeded (e.g., excessive retries, sequential use across multiple platforms, abnormal request/query volumes), requests may be blocked and no refund is due.
7.3. Delivery depends on carrier constraints, target service policies, spam filters, and regional restrictions. GetCode makes no commitment of success for any particular platform.


8. Third Parties and App Store Terms

8.1. The Service relies on third parties such as carriers, number aggregators, payment providers, and Apple App Store/Google Play. Their terms apply in addition to these Terms.
8.2. For purchases via Apple/Google, the respective store refund policies may apply.
8.3. GetCode does not control and is not responsible for the availability, continuity, or rules of such third parties.


9. Intellectual Property

All rights in and to the Service, software, designs, texts/graphics, and trademarks belong to GetCode or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.


10. Privacy and Personal Data

Your personal data is processed in accordance with our Privacy Policy and applicable data protection laws. We implement appropriate technical and organizational measures. To prevent abuse, certain activities may be monitored using risk scoring, device fingerprinting, IP and transaction logs.


11. Compliance and Identity Verification (KYC)

Where risk of abuse is suspected or required by law, you may be asked to verify your identity (KYC). Failure to comply may result in suspension of access to the Service.


12. Term and Termination

12.1. You or GetCode may terminate the account at any time.
12.2. Access may be immediately suspended for AUP violations, suspected fraud, payment issues, or legal obligations.
12.3. Termination does not affect accrued rights and obligations; intellectual property, liability limitations, indemnities, and dispute resolution provisions survive termination.


13. Disclaimers and Limitations of Liability

13.1. The Service is provided “as is” without warranties of uninterrupted or error‑free operation or any specific success rate.
13.2. To the maximum extent permitted by law, GetCode is not liable for indirect, incidental, special, punitive, or consequential damages; loss of profit/goodwill/records, data loss, or business interruption.
13.3. Subject to mandatory consumer rights, GetCode’s total liability is limited to the amount paid for the transaction giving rise to the claim.


14. Indemnification

You agree to indemnify and hold harmless GetCode from any and all claims, penalties, losses, costs, and reasonable attorneys’ fees arising out of your violation of these Terms, infringement of third‑party rights, or unlawful activities.


15. Service Changes and Maintenance

GetCode may modify, suspend, or discontinue the Service, in whole or in part, temporarily or permanently. Planned maintenance windows will be announced within reasonable time.


16. Force Majeure

GetCode is not responsible for failure or delay due to events beyond its reasonable control, including natural disasters, war, strikes, infrastructure/energy/communication outages, governmental actions, or pandemics.


17. Notices and Electronic Contracting

These Terms are concluded electronically. Notices may be provided via your registered email or in‑app notifications.


18. Governing Law and Dispute Resolution

18.1. If you are a consumer, disputes fall under the jurisdiction of the Consumer Arbitration Committees and Consumer Courts at your residence or where the transaction took place (as applicable under Turkish law).
18.2. If you are a merchant or professional, these Terms are governed by the laws of Türkiye and courts and enforcement offices of Istanbul have exclusive jurisdiction.


19. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced reasonably in advance of the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.


20. Miscellaneous

Severability: If any provision is held invalid, the remaining provisions remain in effect.

Assignment: GetCode may assign these Terms and its rights/obligations to its affiliates. You may not assign without prior written consent.

Priority: The Turkish version prevails; translations are for convenience only.

Headings: Headings are for convenience and do not affect interpretation.
